Blooms provides a platform for creators and influencers to showcase their work, create websites, organize content, and connect with their audience. Our Services include, but are not limited to:

• Website and link-in-bio page creation and management tools
• Visual page editor with drag-and-drop design
• Content organization and categorization
• Analytics and performance tracking
• AI-assisted content generation (Bloomie)
• Media file storage and management
• Short links (via blms.my) and custom domain support
• Social media integrations (Instagram)
• Bookmark management

3. User Accounts#

To access certain features of our Services, you must create an account. When creating an account, you agree to the following:

• Age Requirement: You must be at least 13 years old to use the Service. If you are in the EU, you must be at least 16. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.
• Accuracy: You must provide accurate, current, and complete information about yourself.
• Security: You are responsible for maintaining the security of your password and accept all responsibility for activities that occur under your account.
• Notification: You must notify us immediately of any unauthorized use of your account.

4. Subscription Plans#

We offer the following subscription tiers: Free, Starter (with a 7-day free trial), Pro, and Agency. Each plan has different feature limits, including the number of websites, storage, analytics access, and AI credits.

• Free trial: The Starter plan includes a 7-day free trial. You will not be charged until the trial ends.
• Billing: Paid plans are billed monthly or annually. You authorize us to charge your payment method on a recurring basis.
• Changes: We reserve the right to change pricing with at least 30 days' notice.

5. Use of Services#

You agree to use our Services only for lawful purposes. You agree NOT to:

• Violate any applicable laws or regulations.
• Infringe upon the rights of others.
• Transmit any harmful, offensive, or illegal content.
• Attempt to gain unauthorized access to our Services.
• Use automated systems (bots, scrapers) to access the Services without permission.
• Reproduce, duplicate, or copy any portion of the Services.
• Use the Services to distribute spam, malware, or phishing content.
• Impersonate another person or misrepresent your affiliation.

6. Intellectual Property#

The Services and their original content, features, and functionality are owned by Blooms and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

User Content: You retain ownership of any content you upload, create, or submit through the Services. By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your User Content solely for the purpose of providing and improving our Services.

7. AI Features (Bloomie)#

Our Services include features powered by Artificial Intelligence ("AI"), including the "Bloomie" assistant. By using these features, you acknowledge that:

1. Data Processing: Your conversation messages are sent to third-party AI providers for processing. These providers do not use your data to train their models.
2. Credit System: AI usage is subject to a monthly credit quota that varies by subscription plan. Credits reset monthly.
3. Accuracy: AI output may be inaccurate, offensive, or misleading. You should not rely on AI output as a substitute for professional advice. You are solely responsible for reviewing and verifying any content generated by AI before publishing it.
4. No Copyright on Output: Due to the nature of AI, content generated by AI may not be copyrightable or may be similar to content generated for other users.
5. Input Data: You agree not to provide sensitive personal data (health, financial information) to the AI interface.
6. Memory: Bloomie may store contextual information about your preferences (niche, tone, goals) to personalize responses. You can clear this data at any time.

8. Social Integrations#

The Services allow you to connect third-party accounts, including Instagram. By connecting a social account, you:

• Authorize Blooms to access your account data as permitted by the platform (messages, media, analytics)
• Acknowledge that your use is also subject to the third party's terms of service and privacy policy
• Can disconnect the integration at any time, which stops further data syncing
• Understand that previously synced data may be retained in accordance with our Privacy Policy

9. Short Links and Custom Domains#

• Short links (blms.my) redirect visitors to your designated URLs. We track click analytics on short links.
• Custom domains may be available depending on your plan. You are responsible for ensuring you have the right to use any custom domain you configure.
• We reserve the right to disable short links or custom domains that are used for spam, phishing, or illegal activity.

10. Content Moderation#

We maintain a content moderation system to ensure the safety and integrity of the platform.

• Reporting: Users can report content they believe violates these Terms. Reports are rate-limited to prevent abuse.
• Review: Reported content is reviewed by our team. We may hide, remove, or restrict content that violates these Terms.
• Enforcement: Violations may result in content removal, account suspension, or permanent ban.

11. DMCA Copyright Policy#

Blooms respects the intellectual property rights of others. It is our policy to respond to any claim that Content posted on the Service infringes on the copyright or other intellectual property rights of any person or entity.

If you are a copyright owner, or authorized on behalf of one, and you believe that the copyrighted work has been copied in a way that constitutes copyright infringement, please submit your claim via email to [email protected], with the subject line: "Copyright Infringement" and include a detailed description of the alleged infringement.

Zero Tolerance: We reserve the right to terminate User accounts that are determined to be repeat infringers.

12. Usernames and Subdomains#

You have no proprietary rights to any username, handle, or subdomain (e.g., blooms.my/@username) provided through the Services. We reserve the right to reclaim, change, or remove any username or subdomain at any time, for any reason, including but not limited to claims of trademark infringement or prolonged inactivity.

13. Refunds and Right of Withdrawal#

For EU/UK Consumers: By subscribing to our Service and accessing the digital content immediately, you expressly waive your right of withdrawal (the 14-day cooling-off period) typically afforded under consumer protection laws.

General Policy: Except when required by law or in case of technical failure on our end, paid Subscription fees are non-refundable. See our Refund Policy for details.

14. Privacy and Data#

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Services, you consent to the collection and use of your information as described in our Privacy Policy.

15. Termination#

We may terminate or suspend your account and access to the Services immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the Services will immediately cease.

16. Disclaimers#

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

17. Limitation of Liability#

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL BLOOMS, ITS AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATING TO THE USE OF THE SERVICES.

18. Governing Law#

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Paris, France.

19. Changes to Terms#

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Services after any changes constitutes acceptance of those changes.
